To make reservations and/or purchases for either yourself or for another person, you also warrant that you are legally authorized to do so.

GOVERNING LAW AND LANGUAGE

In the event of a discrepancy between the English version and any translation of any provisions of these Terms of Use, the English version shall prevail.

In the event of any provision of these Terms of Use being found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms of Use. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

RESERVATIONS GENERAL TERMS

The reservations feature of this Site is provided solely to assist customers in determining the availability of travel-related goods and services and to make legitimate reservations, and for no other purposes. You may only make reservations if you are of sufficient legal age and you agree to be financially responsible for all of your use of this Site. You also warrant that all information supplied by you in using this Site is true and accurate. You should only make reservations for yourself and your invited guests or for an individual for whom you are authorized in advance to act. In this PICS, we wish to explain the types of personal data the Hotel collects and how the Hotel would use your personal data.

TYPES OF PERSONAL DATA WE COLLECT

1.   Contact Details: Your name, e-mail address, phone number, physical address (billing), company affiliation, title;

2.  Demographic Data: Demographic information and location data, and government-issued identifiers (e.g., drivers’ license (including dates of birth), passport numbers or other national identifiers);

3.  Financial Details: Your credit card and/or debit card details;

4.  Guest Stay Information: Guest stay information, special requests and preferences, telephone numbers dialed, faxes and telephone messages received;

5.  Log Details: IP addresses;

6.  Social Media Details: Social media account information, profile pictures or posts;

7.  Your Feedback: Information, feedback or content you provide regarding your marketing preferences, in surveys, comment cards, or promotional offers on our Services and those of third parties;

8.  CCTV/Surveillance: For your safety and security, images and visual recordings through the use of closed-circuit television systems collected while visiting our hotels, where permitted by applicable law;

9.  Call Recordings: Conversations, including records or monitoring of guest service calls for quality assurance and training purposes, and other communications such as in-app messages or SMS text messages, where permitted by applicable law or based upon consent;

10.  Corporate Account Data: Contact details concerning the employees of corporate accounts and vendors and other individuals with whom we do business (e.g., travel agents, bookers, event planners); and

11.  Other Data: Other types of information that you voluntarily choose to provide to us. 

Use of Information in Direct Marketing: We intend to use your contact information (such as name, email address and phone number) to send marketing materials or make appropriate promotional offers to you.  The marketing or promotional materials may cover the following: (i) hotel and hospitality; (ii) catering, food and beverage; (iii) leisure and entertainment; and (iv) any products, services or facilities which we think may be of interest to you.  We may share your contact information or enable our affiliated hotels brands, Partner Companies and/or marketing service providers to send direct marketing materials and make promotional offers to you if we feel these might be of interest to you, in relation to the same classes of marketing subjects.  

We will only use your contact information for direct marketing or promotional purposes if you have provided your consent (or your indication of no objection) for us to do so.  We will not send such messages to you if you have unsubscribed from receiving these messages.

TRANSFER OF DATA

Your personal data will be kept confidential by the Hotel but we may transfer or disclose such personal data to (i) our contractors under a duty of confidentiality to us who provide administrative, telecommunications, computer, data processing or other services to us in connection with management, operation and maintenance of the system with the purpose of personal data collection and (ii) the Group for the purpose of doing researches and/or analysis.

ACCESS TO DATA 

You have the right to request access to and correct your personal data in accordance with the provisions of the Personal Data (Privacy) Ordinance (Cap.486). Any data access request or data correction request may be made to us at stanford@stanfordhotels.com.

AMENDS OR UPDATES TO THE PRIVACY STATEMENT

Stanford Hotels reserves full rights to amend or update this Privacy Statement at our discretion from time to time as it sees fit or necessary to meet any change in any of the relevant laws or the regulatory environment, or business needs, or to satisfy the needs of our guests, properties, strategic marketing partners, and service providers or to meet any other purposes. Updated versions will be posted to our web site and date stamped so that you are always aware of when the Privacy Statement was last updated. The whole contents of this Privacy Statement will then be construed accordingly in conjunction with such amended or updated versions.

LEGAL DISCLAIMER

In addition to our rights of disclosure as mentioned hereinabove, we may also disclose your personal information when required by law or court order, or as requested by other government or law enforcement authorities, or in the good faith that disclosure is otherwise necessary or advisable including and without limitation to protect the rights or properties of Stanford Hotels.
